Staff Analysis of the Legislation

HB 190 amends Chapter 3 of Title 19 of the O.C.G.A. by defining antenuptial agreements and requiring that they be in writing and signed by both parties with at least two witnesses, one of whom is a notary. HB 190 clarifies in 19-3-66 the two instances in which antenuptial agreements may be enforced. Lastly, HB 190 removes sections (a) and (b) of 19-3-62 and 19-3-68, and the last lines (58-59) of 19-3-65 stating that the clerk of superior court should have the proceedings of each case in the book of minutes.
