Staff Analysis of the Legislation

SB 99 amends §35-3-34, by allowing a person who was involuntarily hospitalized to petition the court where the hospitalization proceedings took place for relief. Such a petition can only be filed after information regarding the person’s mental health is submitted to the Georgia Crime Information Center. The court will be required to hear the petition within 60 days and grant such petition if it finds by a preponderance of the evidence that the petitioner will not likely act in a manner dangerous to himself or herself or to public safety.
