Staff Analysis of the Legislation

HB 281 amends Chapter 7 of Title 44 of the OCGA by adding Article 6, the Georgia Tenant Victim Protection Act. Article 6 protects tenants who are victims of family violence, sexual assault, unlawful harassment and stalking and have notified their landlord. The report cannot have the name of the alleged perpetrator.  The landlord can then terminate the rental agreement, though it must occur within 30 days of the reported act, and the tenant is only responsible for payment up to the last day of that month. Code 44-7-123 protects the tenant by stating that a tenant screening service cannot disclose if the applicant has been a victim of the above mentioned crimes or has terminated a rental agreement because of this.
