Staff Analysis of the Legislation

HB 258 amends Title 16 of the OCGA by increasing the minimum imprisonment for aggravated assault with a firearm upon a peace offer from five to ten years. The imprisonment time cannot be reduced. In addition, HB 258 adds a clause regarding a second offense for obstructing or opposing a law enforcement officer, prison guard, correctional officer, community supervisor officer, or Department of Juvenile Justice probation officer shall be imprisoned for 2-10 years. A third offense is punishable for 3-15 years of imprisonment, and the time to be served cannot be reduced.
