Staff Analysis of the Legislation

HB 292 amends Part 3 of Article 4 of Chapter 11 of Title 16 of Code Section 35-3-34 and Chapter 1 of Title 51 of the OCGA. Code Section 16-11-126 adds a section stating that a non-Georgian weapons license holder is authorized for up to 90 days to carry a weapon after moving to Georgia. In addition, it waive the requirement of any not required by law to have a hunting or finishing license to have one while hunting, fishing, or sport shooting. Section 16-11-127.1 adds the exception that the list does not apply to persons provided for under 16-11-120. Section 16-11-129 states that if gun safety advice is issued by a judge of a probate court, he or she must print the source of the information. In addition, individuals are not required to take classes provided by the Department of Natural Resources that are solely for the convenience of the citizens of the state. HB 292 also amends duties of the probate judge in instance of name change of weapon carry license applicants and renewals, and changes the exceptions for code section 35-3-34, which detail instances of disclosure and dissemination of criminal records in correlation to the national Instant Criminal Background Check System.
