Staff Analysis of the Legislation

SB 142 amends Article 2 of Chapter 14 of Title 40 of the OCGA. It clarifies that speed detection devices can only be operated by registered or certified peace officers of the county sheriff, county, municipality, or college who have a permit. Section 3 adds these exception into laws regarding testing the device for accuracy, maintaining results, and the rights of individuals to request testing of devices. Instead, the law enforcement agency will test the accuracy every 30 days and have it calibrated every 12 months. If a stationary device is erected near school zones, there must be signs notifying drivers. Monetary penalties established based on these devices shall not be considered when calculating speeding fines, unless it is in a school zone. In this case, the fine will be $125 with an additional fee amount that cannot exceed $25, which will be sent first class to the owner of the motor vehicle. The fees will be accompanied by proof of violation, which is deemed noncriminal.  Recorded images are not public record.
