Staff Analysis of the Legislation

SB 241 amends Chapter 13 of Title 16 of the OCGA. The term “agency” is replaced by “department,” which is referring to the Department of Public Health. In addition, section 16-13-57 clarifies the purpose of the program to be for health oversight and data gathering for epidemiological research. Section five adds GBI as an appropriate authority to refer probable violations of distribution of controlled substances. Lastly, section 10 states that in the event that a deceased person has controlled substances on their possession it can be transferred to a hospice patient family unit or care team to dispose of it.
