Staff Analysis of the Legislation
HB 505 amends Code Section 9-16-15 of the OCGA amends subsections (a) and (b). Subsection (a) states that the court shall stay civil forfeiture proceedings unless the owner or interest holder of the property waives the stay. Subsection (b) corrects language and states that an acquittal or dismissal in a criminal proceeding shall preclude civil forfeiture proceedings.
