Staff Analysis of the Legislation

 SB 326 amends Part 3 of Article 6 of Chapter 11 of Title 15, Title 17, Article 1 of Chapter 7 of Title 31, Article 1 of Chapter 3 of Title 35, and Chapter 4A of Title 49 of the OCGA.  This Act is known as the "Sheltering Adolescent from Destructive Environments (Sade's) Law".  Persons posting bail for delinquent children will have to sign a sworn and notarized affidavit with the court stating he or she has legal custody of such child or is an adult blood relative or stepparent of such child and will immediately return such child to the individual or entity having legal custody.  Additionally, any person arrested by a law enforcement officer will have a criminal history records check conducted by a law enforcement officer of the Georgia Crime Information Center in order to determine if they are a wanted or missing person or are reasonably believed to be subjected to labor or sexual servitude.  If any of the conditions are met, the officer will then notify the Georgia Bureau of Investigation.  No person shall act for a defendant under the age of 18 unless the person has legal custody or is an adult blood relative or stepparent of the defendant and shall present a sworn and notarized affidavit proving such.
