HB 738 amends §1-5-53 of the O.C.G.A., relating to the right to offer a will for probate. It defines an “interested person,” who is able to offer the will for probate if the executor fails to do so promptly, as any legatee, devisee, creditor of the decedent, purchaser from an heir of the decedent, administrator appointed for the decedent prior to the discovery of the will, or any individual making a claim under an earlier will.
