Staff Analysis of the Legislation

SB 452 amends Title 17 and Title 42 of the O.C.G.A. If a peace officer finds that a suspect is an illegal alien during an investigation into their identity, the officer may notify and transfer all information gained to the prosecuting attorney. Upon sentencing a defendant convicted of a felony, the court shall inquire and determine if they are lawfully present in the United States. If found not lawfully present, the sentencing court shall order the prosecuting attorney to: immediately notify the United States Department of Homeland Security and make other appropriate notifications to the sheriff or municipal custodial officer, United States Immigration and Customs Enforcement, the Department of Corrections, the STate Board of PArdons and Paroles, and/or the Department of Community Supervision or probation provider.
