Staff Analysis of the Legislation

HB 981 amends §17-17-12 and §35-3-37 of the O.C.G.A. It allows individuals convicted of certain misdemeanors and felonies who have not been arrested for any further criminal offenses and who have completed the terms of his/her sentence to petition the court in which the conviction occurred to restrict access to criminal history record information. It also requires that the prosecuting attorney notify the victim of the date, time, and place of any court proceedings related to a petition for record restriction.
