HB 1006 amends Chapter 6 of the O.C.G.A. It establishes a difference between sexual assault of the first degree and of the second degree. It first defines sexual assault in the “second degree” and determines that a person convicted shall be punished with imprisonment between 1 and 5 years and a fine not to exceed $25,000, but if the act was against a child under the age of 16, they shall instead be imprisoned for between 5 and 20 years. It then defines sexual assault in the “first degree” as being committed by a person with a supervisory or disciplinary authority. Sexual assault in the first degree is punished with imprisonment of 1 to 25 years with a fine not to exceed $100,000 and if the crime is against a child under 16, it is punished with imprisonment between 25 and 50 years.
