Staff Analysis of the Legislation

HB 79 amends Code Section 30-4-5 of the O.C.G.A to add protections to those charged with the care of a child and who are also legally blind. The bill mandates that no court, department, or child-placing agency is legally authorized to deny: child placement, custody, visitation, guardianship, foster care, or adoption based solely on that individual’s blindness. Additionally, parties petitioning the removal of the child from the care of the individual must bear the burdon of proof that the individual’s blindness is endangering the child’s life.
