Staff Analysis of the Legislation

SB 77 amends Title 50 of the O.C.G.A to state that any person who damages, destroys, loses, or permanently removes monument hall be liable for triple the amount of the full cost of repair or replacement of such monument in addition to attorney fees and court costs. Government agencies are allowed to move monuments if necessary for construction, but monuments moved for such reasons must be placed in places of similar prominence within the same county or municipality in which it originally stood. Additionally, monuments cannot be relocated to a museum, cemetery, or mausoleum if it was not originally located in such a place.
