Staff Analysis of the Legislation

HB 345 amends Title 42 of the O.C.G.A to prohibit certain practices from being used on female inmates during the pregnancy and the immediate postpartum period. Among other things, the bill provides restrictions on shackling these inmates and prohibits their placement in solitary confinement. HB 345 also states that pregnant inmates who are held in jail awaiting transfer to a state penal institution should be transferred as expeditiously as possible and instructs county sheriffs to make all reasonable actions necessary to facilitate such transfers.
