Staff Analysis of the Legislation

HB 424 moves to amend Code Section 16-15-3 and Title 24 of the O.C.G.A to include human sex trafficking, prostitution, pimping and pandering into the definition of criminal gang activity. The legislation revises the rules pertaining to the admissibility of evidence of a complainant’s past sexual behavior in prosecutions for offenses of alleged sexual misconduct. Additionally, the bill repeals the penalty of battery and redefines the term “exploit” against a person 65 years of age or older. The bill also allows Georgia Peace Officer Standards and Training certified investigators to conduct inspections of unlicensed personal care homes, and it further amends the punishment of improper licensing and crimes against elder persons.
