HB 417 amends Title 43 of the OCGA to revise trauma scene cleanup service regulations. A trauma scene waste management practitioner must register with the Secretary of State with a $100 fee every three years. The Secretary of State will maintain a list of such practitioners on its website. Prior to registration and for every 3 years, a practitioner must submit to a fingerprint background check. Persons convicted of a felony are not eligible to become practitioners. Each practitioner must have a $25,000 bond and liability insurance for at least $100,000. Practitioners must also submit proof of a permit from the Department of Natural Resource’s Environmental Protection Division and proof of all current certifications in the disposal of regulated biomedical waste. Legislation does not prevent a private property owner from cleaning up a scene on their property themselves or other individuals not from a commercial enterprise performing on behalf of the property owner. Furthermore, the bill allows the Secretary of State to issue temporary 90-day registrations in the event of a declared public emergency or state of emergency.
