Staff Analysis of the Legislation

HB 440 amends Chapter 11 of Title 15 of the OCGA to expand the term ‘child’ and the jurisdiction of the juvenile court to include persons under 18 years of age. All persons below the age of 18 will now be subjected to the same court process. Consequentially, the term ‘prisoner’ in the “Prison Litigation Reform Act of 1996” is revised to encompass only persons 18 years of age or older.
