Staff Analysis of the Legislation

HB 544 amends Chapter 7 of Title 37 of the OCGA to include the affidavits of alcoholics, drug dependent individuals, and drug abusers, to be part of the patient evaluation and among the documents that influence treatment decisions such as the holding the discharge of a patient if it would result in imminent danger to the patient or others. The patient and the patient’s affidavits shall be notified by the courts of the patient’s discharge and any court-ordered treatment plan provided by the evaluating physician or psychologist.  This person must participate in the court-ordered treatment plan and treatment facility shall report weekly to the court regarding the patient’s attendance and progress.
