Staff Analysis of the Legislation

HB 641 amends Article 1 of Chapter 3 of Title 35 of the OCGA to grant the Georgia Bureau of Investigation powers and duties to investigate cybercrimes outlined in the “Georgia Computer Systems Protection Act”. With jurisdictional authority, the GBI may investigate a cybercrime without a formal request. The GBI may also issue a subpoena with the consent of a prosecuting attorney to compel the production of electronic or remote communication services. If a party fails to comply with a subpoena, the GBI through the Attorney General or district attorney may apply to a superior court for an order compelling complianc
