Staff Analysis of the Legislation

HB 724 amends Code Section 16-13-2 of the OCGA to authorize each county’s governing authority to adopt ordinances governing the possession of one ounce or less of marijuana within unincorporated areas of the county. Violation of these ordinances may be punishable by fines. Each ordinance must specify the maximum punishment imposed for violation of the ordinance which cannot exceed a $1,000.00 fine. All fines and bond forfeitures from prosecution will be paid to the governing county’s treasury.
