HB 751 amends Code Section 16-11-173 of the OCGA to define the
term ‘extreme risk protection order’ as an executive order issued by a federal
or state court or signed by a judge or comparable officer to prohibit an
individual from having a firearm for the purpose of reducing risk. The bill nullifies
all extreme risk protection orders that infringe on a citizen’s constitutional
rights and prohibits state actors from accepting federal grants that would
incentivize the enforcement of this type of order. Any individual who attempts
to enforce an order is guilt of a felony and will be punished with 1-3 years of
imprisonment and/or a $1,000-5,000 fine. The bill preempts all Georgia legislation
related to extreme risk protection orders. |
