Staff Analysis of the Legislation

SB 410 amends Chapter 5 of Title 48 of the OCGA to make various changes to the ad valorem tax appeals process. The states that when either the taxpayer or the board  of  assessors appeals to the superior court and the final determination is f value on appeal is 85 percent or less of the valuation set by the county board of equalization, hearing officer, or arbitrator as to any real property, the taxpayer is entitled to recover costs of litigation and attorneys fees. Any appeal of an award of attorney's fees by the county shall be specifically approved by the governing authority of the county
