Staff Analysis of the Legislation

SB 423 amends Code Section 16-5-61 of the OCGA to expand the definition of ‘hazing’ and to include minors as subjects of hazing. Any person convicted of hazing will be guilty of a misdemeanor and shall be subjected to a jail term of one to five years and/or a fine of $5,000 to $50,000 depending on the severity of the hazing. If the minor or student suffers serious bodily injury or death as a result of such hazing, the convicted person will be guilty of a felony. Attorney General is authorized to bring civil actions against certain organizations for hazing incidents. This bill also amends Chapter 1 of Title 20 to require postsecondary Georgia schools provide mandatory public reports detailing the school’s hazing violations.
