Staff Analysis of the Legislation

SB 40 revises the time and method for opening and tabulating absentee ballots so that beginning on the second Monday prior to a primary, election, or runoff, registrars or absentee ballot clerks will open the outer envelope and remove its content before proceeding to open the inner envelope containing the ballot and tabulate it. Three people who are registrars, deputy registrars, or absentee ballot clerks must be present while the absentee ballots are opened and scanned. At the timely request by the superintendent, registrars or ballot clerks will deliver the absentee ballots to a location of the superintendents' discretion, where he or she will cause the certified absentee ballots to be opened and tabulated.
