Staff Analysis of the Legislation

HB 133 amends Chapter 17 of Title 17 of the OCGA to mandate that judges presiding over all judicial proceedings where victim notification is required, verify with the prosecuting attorney as to whether or not the victim has been notified. If the notification has been made, the court must ask if the victim will participate in the proceeding. If the notification has not been made, the court will inquire as to why and direct the prosecuting attorney to rectify the notification failure if necessary.
