Staff Analysis of the Legislation

HB 363 removes various subsections of Title 16 of the OCGA that escalate punishment for elder crimes due to rule of lenity concerns with existing law. The bill further creates the terminology "abuse of access", defined as illegally taking resources that belong to a disabled adult or elder person when the access to said resources were obtained due to the disabled/elder’s incapacity. "Abuse of access” is additionally included the definition of "exploit".
