Staff Analysis of the Legislation

SB 174 allows appointed judges that are fulfilling a vacancy of an elected judge to issue an unsecured judicial release for qualifying individuals. The definition of "unsecured judicial release" is revised to clarify that its is a release that does not have a dollar amount required to be secured, and that it is either on a person's own recognizance or for purposes of entering a qualifying pretrial program.  

SB 174 adds the felony offenses of burglary, entering an automobile with intent to commit theft or felony, and stalking to the definition of "bail restricted offense." SB 174 further adds the misdemeanor offenses of "crimes involving family violence" and stalking to the definition of "bail restricted offense."
