Staff Analysis of the Legislation

This bill prohibits a person acting on behalf of a school district or a person who aids another person acting on behalf of a school district from using school time to espouse a political ideology or religious belief, unless it is germane to the subject matter of the class or activity.

Establishes penalties against school districts, charter schools, and persons for violating this prohibition. Establishes penalties against school districts, charter schools, and persons for violating this prohibition.

Allows the parent of a child who enrolled at a school that is part of a school district to initiate a suit in superior court to enforce compliance with this statute.

Mandates that all penalties collected by the superior court for a suit initiated by a parent shall be transferred to the State Treasurer for deposit in the state General Fund.  

Committee on Education removed the following provisions:

  1.  The penalties prescribed against school districts and charter schools apply to each violation.
  2. A parent of a child who is enrolled at a school that is part of a district may initiiate a suit in the Superior Court to enforce compliance with this section.
  3. Penalties collected by the court for a suit initiated by a parent are to be transferred to the State Treasurer for deposit into the state General Fund.
