Staff Analysis of the Legislation

SUMMARY:

Adds the requirement that each local board of education shall adopt a code of ethics to govern members of the local board of education.  Each local board shall annually review its code of ethics and shall announce such review and any changes in the code of ethics at regular meetings of the board.

REQUIREMENTS:

POINTS TO CONSIDER:

  • Makes uniform the legal standard that all boards of education adopt, review, and publicize changes in its code of ethics.
  • Content of the code of ethics is determined by each local board of education.
  • Enforcement of the code of ethics is determined by each local board of education.
  • The bill does not refer to penalties should a local board be found in violations of the provisions of the bill.  In general, failure to follow state law could ultimately result in state funds being withheld from local school districts. In addition, local board members who violate state ethics code provisions found in OCGA 45-10-1 may be removed from office by the Governor if found in violation of such provisions.
  • Many Georgia boards of education have adopted codes of ethics.

EFFECTIVE DATE:

Upon signature of the Governor or by becoming law without such signature.
