SUMMARY:  LC 33 3423 EC
Makes tampering with state assessments a misdemeanor.

REQUIREMENTS:
The following acts shall be unlawful:

  • allow those taking a test to see test questions before or after administration of the test
  • copy or reproduce all or portions of a secure test booklet
  • provide inappropriate guidance to test takers that would allow them to get answers correct they might not have known
  • alter or interfere with answers in anyway
  • make answer keys available
  • failure to follow test security provisions
  • superintendents or principals to knowingly or willfully fail to develop, implement, and enforce local board and state board testing policies
  • participate in, direct, aid, counsel, assist in, encourage, or fail to report any of the acts listed above

Violation of the above shall be deemed a misdemeanor with penalty of a fine of up to $1,000 or 30 days imprisonment or both; suspension or revocation of certification by the Professional Standards Commission; ineligibility for performance pay consideration; forfeiture of rights with respect to retirement benefits.

EFFECTIVE DATE:  Upon approval of the Governor or by becoming law without such approval.
