Staff Analysis of the Legislation

SUMMARY: Creates a statewide uniform concussion education, training, and return to play protocol.  Requires schools and youth athletic organizations to provide concussion-related information to athletes and parents; to provide a concussion recognition program to coaches and others; to establish a return to play policy.

REQUIREMENTS:
  • applies to youth athletes between the ages of 7-18
  • requires boards of education and governing boards of private schools to:
    • provide an information sheet on the nature of concussions and procedures to be followed should a concussion occur to athletes, parents, and coaches
      • parents must sign acknowledgment of receipt of such information
    • ensure that each coach and other personnel designated by the school complete an annual concussion recognition education course and certify in writing that the course has been completed.  Content of the course is defined in the legislation.
    • ensure staff compliance with steps defined in the legislation should an injury of suspected injury occur
    • notify parents if a student is removed from play as a result of a suspected concussion; the student shall not be allowed to return to play or other related physical activities until permission is granted from a health care provider
  • similar provisions are defined for youth athletic associations with the exception that training for coaches is encouraged rather than required
POINTS TO CONSIDER:
  • the bill contains language which attempts to preclude liability for entities and employees as they carry out required provisions
  • costs of implementing the legislation are the responsibility of the local board, private school, or youth organization

 

EFFECTIVE DATE:  upon approval of the General Assembly and Governor.
