Staff Analysis of the Legislation

SUMMARY:  Requires that private schools that enroll student utilizing a scholarship or tuition grant from a student scholarship organization shall be subject to the Open Records Act.  Such school shall report annually to the Department of Education:

  •  the total number of scholarship students enrolled utilizing a scholarship or tuition grant from a scholarship organization
  • the total amount of scholarships or tuition funding received on behalf of students and the individual amounts received on behalf of each student
  • data on scholarship students and the dates attended
  • aggregated data on scholarship students with respect to race, ethnicity and gender

The legislation removes an annual increase in the total amount of tax credits allowed statewide currently tied to a federal index.

EFFECTIVE DATE: Upon approval by the Governor.
