SUMMARY:  LC 43 0168  (See also HR 1017)

Proposes a constitutional amendment which, if passed, would allow local boards of education to impose, levy, and collect development impact fees and use the proceeds to pay for a share of the cost of additional educational facilities.

REQUIREMENTS:

• to qualify, the school system must have had enrollment growth of at least 15 percent over the preceding five-year period
• the impact fee is to be collected by the county or municipality where the fee is implemented
• proceeds from the fee shall be used to pay for a share of the cost of additional educational educational facilities to serve new growth and development in the same area in which these fees are imposed

EFFECTIVE DATE:  

Upon approval by 2/3 votes by the House and Senate and approval by voters.
