Staff Analysis of the Legislation

SUMMARY:  LC 29 6798 LC 29 6901S (SCS)  Requires local governing bodies to provide certification of compliance relating to immigration sanctuary policies as a condition of funding from state agencies.

POINTS TO CONSIDER:  Current law prohibits local governing bodies from enacting, adopting, implementing, or enforcing any sanctuary policy.  

Sanctuary policy is defined as any regulation, rule, policy, or practice adopted which prohibits or restricts local officials or employees from communicating or cooperating with federal officials or law enforcement officers with regard to reporting immigration status information while the local official or employee is acting within the scope of his or her official duties.

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor.
