Staff Analysis of the Legislation

SUMMARY:  LC 33 6332ER  Requires schools to provide certain information to students and parents prior to using any digital-learning platform; to destroy student data collected by such platform, etc.

REQUIREMENTS:

  • provide information to parents and students 18 years of age and older a formal written explanation of the goals and capabilities of the platform including:
    • how the platform works and its purpose
    • title and address of the school official and contractor responsible for the platform
    • information the software is designed to collect
    • every element of data to be collected and its purpose
    • every contemplated use or disclosure of such data
    • the privacy policy maintained by the provider
    • policies and practices of the school regarding storage, access,etc. of the records collected
  • include a portal allowing parents access to the platform
  • destroy data collected at the end of the course
  • allow the opt out of students of use any data-learning platform; such students must be provided instruction in the traditional manner 

EFFECTIVE DATE: Upon approval by the General Assembly and Governor.
