SUMMARY:  LC 30 0846  The "Too Young to Suspend Act"  Limits the reasons a principal can suspend a student in grades pre-K or kindergarten.

REQUIREMENTS:  

A student in pre-kindergarten or kindergarten may not be suspended or expelled unless the principal determines the student has committed one of the following acts:

• caused or threatened serious bodily injury to another person except in self-defense
• possessed or furnished to another person a firearm, knife, explosive, or other dangerous substance or object while on school property 

The superintendent may:

• transfer a student if it would be a more appropriate placement due to a student's disabilities or special needs
• suspend a student during an investigation into whether a student can be lawfully suspended or expelled  

The state superintendent is to issue guidelines or implementation of this law, including recommendations on the length of suspension if the student has committed the act(s) listed above.

Local systems must submit an annual report to the state superintendent of all such suspensions and/or expulsions. 

EFFECTIVE DATE:  Upon approval of the General Assembly and Governor.
