SUMMARY:  LC 29 6417S  LC 6643S

Changes provisions of law related to mandatory reporting of child abuse.

REQUIREMENTS:

  • reporting by those persons listed in the law is required if there is reasonable cause to believe that suspected child abuse has occurred 
  • when a person required to report child abuse receives reliable information that child abuse has occurred, that person shall notify the person in charge (or their delegate) of the facility/entity/ and the person in charge shall report or cause to be reported without changes to the appropriate authorities
    • reports shall be made immediately, and in no case later than 24 hours from the suspected abuse is identified and may be made orally, by phone, or written through electronic means
    • if an electronic report is made to the Division of Family and Children's Services it is to be done in the manner specified by the division.  Oral reports to the Division shall be followed by a later report in writing, if requested, to a child welfare agency providing protective services or to an appropriate police agency as designated by the Division.
