SUMMARY:  SB 126/HCSFA 

Authorizes prescriptions of auto-injectable epinephrine to an authorized entity for emergency purposes; authorizes prescriptions of levalbuterol sulfate to schools; authorizes pharmacists to fill the prescriptions 

 

PROVISIONS:

Physicians, advanced practice registered nurses acting under the authority of 43-34-25, and a physician assistant acting under the authority of 43-34-103 may prescribe auto-injectable epinephrine in the name of an authorized entity and pharmacist may dispense accordingly

Physicians, advanced practice registered nurses acting under the authority of 43-34-25, and a physician assistant acting under the authority of 43-34-103 may prescribe levalbuterol sulfate or albuterol sulfate in the name of a public or private school for use in accordance with 20-2-776.3 and pharmacist may dispense accordingly

Adds definitions for authorized entity and other terms

School may designate an employee or agent trained in the possession and administration of levalbuterol sulfate to be responsible for the storage, maintenance, and distribution of the product stocked by the school

School may enter into agreement with manufacturers or third-party suppliers to obtain the products free of charge or at fair market prices

No later than July 1, 2015 the State Board in consultation with the Department of Public Health shall adopt regulations as necessary to implement the provisions of this Code.

Local boards must adopt a policy authorizing school personnel to administer levalbuterol sulfate, if available, to a student when under perceived respiratory distress whether the student has a prescription or not

Local boards shall provide information to school personnel on recognizing the symptoms of respiratory distress and the correct method of administering the drug.

Includes an immunity clause for school personnel
