Staff Analysis of the Legislation

SUMMARY:  LC 41 0461ERS(SCS)  The "Georgia Religious Freedom Restoration Bill"  Governments should not substantially burden religious exercise without compelling justification.

REQUIREMENTS:

  •  Government (including school districts) shall not substantially burden a person's exercise of religion unless:
    • it is in furtherance of a compelling governmental interest; and
    • it is the least restrictive means of achieving that compelling governmental interest 
  • A person whose religious exercise has been burdened in violation of this legislation may assert that violation as a claim or defense in a judicial proceeding and obtain appropriate relief against government
    • the court may allow the person, if the prevailing party, a reasonable attorney fee as part of costs

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor.
