SUMMARY:  LC 36 2732S

Changes certain provisions relating to the issuance of employment certificates for minors.

REQUIREMENTS:

  • minors at least 12 years old but less than 16 years old shall not be employed or permitted to work for any person, firm, or corporation unless an employment certificate is issued by an appropriate officer
    • appropriate officers include the superintendent (or designee) if the student is enrolled in public school; chief administrative officer (or designee) if the student is enrolled in private school; or person providing instruction if a home school student
  • the Commissioner of Labor will provide blank forms 
  • the minor must provide to the officer a copy of birth certificate and a letter from the prospective employer that the minor describing the type of  employment
  • the issuing officer must provide a letter indicating the student is enrolled full-time and has an attendance record in good standing
  • the State Board of Education can issue a waiver to these requirements if the minor shows clear and convincing evidence that there is an undue hardship created or meeting requirements would be detrimental to the minor's health or welfare 
  • minors 14 years old or older may be employed during vacation from school in the care and maintenance of lawns, gardens and shrubbery if the minor has an employment certificate
  • certificates may be revoked by the Commissioner of Labor 
  • deletes current law requiring the certificate show the minor is between the ages of 17-18 in order to work between the hours of 9 p.m. and 6 a.m. and deletes prohibitions against employment in certain occupations.
