Staff Analysis of the Legislation

SUMMARY:  LC 33 5939  Enabling legislation related to HR 394, a Constitutional amendment dealing with distribution of ESPLOST funds between county and city school districts within the county.

REQUIREMENTS:

  • The net proceeds of a sales tax for educational purposes shall be distributed according to FTE counts of the respective county and city school system(s) within the county, unless there is an agreement between the school systems as to an alternate method of distribution.

POINTS TO CONSIDER/EFECTIVE DATE

  • HR 394 was passed by the House by the required 2/3 majority and now goes to the Senate were a 2/3 vote is also required.  If passed by the Senate, the Constitutional amendment will be submitted to the voters in November, 2016.  If the amendment is passed by the voters and if HB 369 is passed by the House and Senate and signed by the Governor, it will go into effect on January 1, 2017.
