SUMMARY:

LC 49 0106       LC 49 0158S

Would require the State Board of Education to adopt criteria to determine the eligibility of foster care students for special education and related services. Eligibility criteria would include evidence of whether trauma has adversely affected a foster student's educational performance. The Department of Education would be required to provide guidance to the local school systems on how such evaluations should proceed. 

Would also require protocol be developed by each school that receives state funds to immediately assess foster care students upon their enrollment in a new school and determine whether exposure to trauma has had or will have an adverse impaction on the foster care student's education performance.  

 

EFFECTIVE DATE:

If passed, the State Board of Education would be required to develop rules and regulations by January 1, 2021.
