Beginning in the 2022-2023 school year, each elementary school would be required to schedule recess for all students in grades K-5 unless the student had PE or structured activity time or if reasonable circumstances impede recess. The bill includes a list of possible reasonable circumstances that might impede it.

Local boards of education are required to have written policies allowing unstructured break time for students in K-8. Requirements for what must be included in the policy remains as it is in current law.

Gov. Kemp vetoed a similar bill (HB 83) in 2019.
