SB 129 (Senators McKoon, Ligon, Crane, Bethel, Harbin, Gooch - R)

Georgia Religious Freedom Restoration Act

Amends Title 50 of the O.C.G.A. relating to state government by adding a new chapter 50-15A

The bill includes provisions that the Government (including boards of education) shall not substantially burden a person's exercise of religion even if the burden results from a rule of general applicability unless the government demonstrates that the application of such burden is in furtherance of a compelling governmetal interest and is the least restrictive means of furthering such compelling governmental interest.  This bill also provides that a person whose religious exercise has been burdened in violation of this chapter may assert a claim or defense in a judicial proceeding and obtain appropriate relief against the government, including reasonable attorney's fees.
