SUMMARY:

            This bill would amend Code Section 20-2-2068.2 of the O.C.G.A. to revise provisions relating to the use of surplus property of a LBOE by a local charter school.  It also adds "commission charter schools" into provisions for eligibility in the capital outlay for facilities program.

 

REQUIREMENTS:

  • It adds the requirement that there bee a written agreement to specify that any unencumbered funds by a commission charter school must be returned to the Georgia Charter Schools Commission in the event the school terminates operations.
  • LBOE’s would be required to offer to any and all local charter schools:
    • Any surplus or unused facility or property; or
    • Any portion thereof.
  • No rental or leasing fee could be charged or a leasing fee to a local charter school for the existing facility.
  • The property or any interest in it could not be sold or disposed of without LBOE approval.
