SUMMARY:  This bill would amend Chapter 1 of Title 34 to change provisions relating to employer’s immunity for disclosing job performance information.

REQUIRMENTS:

• Defines “job performance” to include:

  • Attitude
  • Awards
  • Demotions
  • Duties
  • Effort
  • Evaluations
  • Knowledge
  • Skills
  • Promotions
  • Disciplinary actions
• Other definitions include:
  • “Owner”
  • “Prospective employer”
  • “Prospective employee”
• Immunity is granted to current or prospective employers unless information is false or deliberately misleading.
• Prospective employee’s consent is required.
