Staff Analysis of the Legislation

            This bill would amend Chapter 1 of title 51 of the O.C.G.A. to limit liability for the governing body of a school in a joint-use agreement with a public or private entity. It specifies requirements for the agreement to include terms and conditions for use of the facility, a hold harmless provision and to be revocable at any time in favor of the governing party, and to be revocable at any time by the governing authority of the school. The entity would be required to maintain adequate $1 million in liability insurance for the duration of the agreement. On or after July 1, 2013, the governing authority of the school would not be liable for damages arising from use of the facility unless gross negligence can be shown.
