Staff Analysis of the Legislation

            This bill would amend Code Section 26-2-370 of the O.C.G.A. to exclude certain events held by nonprofits from the definition of “food service establishment” and to allow a city or county to delegate the authority to issue permits to serve food at those events to the county board of health. The event would have to be held on property belonging to the sponsoring county, municipality, or organization or on property of someone who has given written permission. If someone’s property is used without their written permission, the property owner could sue the organization providing the event. Those permits would be good for only 120 hours or less, and there must be a minimum of 5 days between issuance of the permits. There would be no fees charged the nonprofit for the permit.
